Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of CalmCents, a household budgeting application available at https://calmcents.ca, operated by Anchored Development Co. ("we," "us," or "our").

By creating an account, accessing the service, or clicking any button or link that indicates your agreement, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the service.

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement in your jurisdiction to use CalmCents.

2. Description of Service

CalmCents is a subscription-based household budgeting application designed for families and couples. It allows users to track income, categorize expenses, set budget goals, and share a household budget with a partner or household members.

CalmCents is built with zero-knowledge encryption as a foundational feature: all budget data is encrypted in your browser before being stored on our servers. This means we cannot read your financial data, and neither can the underlying cloud infrastructure providers we use.

We reserve the right to modify, suspend, or discontinue any feature of the service at any time with reasonable notice. We will not make changes that materially degrade the core budgeting functionality without providing prior notice to active subscribers.

3. Subscription & Billing

Access to CalmCents beyond the free trial period requires a paid subscription. Current subscription plans are as follows:

Payment processing. Subscription payments are processed by Freemius, our third-party payment processor. We do not receive, store, or have access to your credit card number or other payment instrument details. By subscribing, you also agree to Freemius's Terms of Service.

Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current plan rate. You will be charged through your payment method on file with Freemius unless you cancel before the renewal date.

Cancellation. You may cancel your subscription at any time from within the CalmCents app settings or through the Freemius customer portal. Cancellation stops future charges; your access continues until the end of the current paid period. We do not offer prorated refunds for partial billing periods unless required by applicable law.

Price changes. We reserve the right to change subscription prices with at least 30 days' notice. Price changes will not affect your current billing period; they take effect at the next renewal.

4. Trial Policy

New accounts receive a 30-day free trial with full access to all CalmCents features. No credit card is required to start your trial.

The free trial is available once per household. A household is defined as the account created when you first sign up, including any household members you invite. Creating multiple accounts to extend trial access is a violation of these Terms and may result in account suspension.

At the end of the trial period, access to budget data entry and editing will be restricted until a subscription is activated. Your existing data is retained and remains accessible after subscribing.

5. Acceptable Use

CalmCents is intended for personal and family household budgeting. By using the service, you agree not to:

  • Use the service for any commercial, resale, or business purpose without our prior written consent
  • Share your account credentials with anyone outside your household
  • Attempt to circumvent subscription or trial restrictions through technical means or by creating duplicate accounts
  • Access or attempt to access another user's account or data
  • Use automated scripts, bots, crawlers, or other tools to scrape, extract, or interact with the service programmatically
  • Upload, transmit, or store content that is unlawful, harmful, or violates the rights of others
  • Attempt to reverse-engineer, decompile, or discover the source code of the CalmCents application
  • Interfere with or disrupt the integrity or performance of the service or its underlying infrastructure
  • Use the service in any way that violates applicable Canadian federal or provincial law, or the laws of your jurisdiction

We reserve the right to investigate suspected violations and to suspend or terminate accounts engaged in prohibited activity without prior notice.

6. Zero-Knowledge Encryption Disclaimer

CalmCents encrypts all budget data in your browser using AES-256-GCM encryption before transmitting it to our servers. Your encryption key is derived from your account credentials and is never sent to or stored by us.

🔒 Because we operate a zero-knowledge architecture, we cannot decrypt your data, reset your encryption key, or recover your budget data if you lose access to your account credentials. You are solely responsible for maintaining access to your login information.

⚠️ If you lose your password and cannot recover your account through Firebase Authentication's standard recovery process, your encrypted budget data may be permanently inaccessible. We strongly recommend keeping a secure record of your login credentials.

This limitation is a deliberate design choice that protects your financial privacy. By using CalmCents, you acknowledge and accept this trade-off.

7. Data & Privacy

Your use of CalmCents is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains what personal information we collect, how we use it, and your rights under Canadian privacy law (PIPEDA).

By agreeing to these Terms, you also consent to the data practices described in our Privacy Policy.

You retain ownership of the budget data you enter into CalmCents. We do not claim any rights to your financial data. You grant us a limited licence to store and process your encrypted data solely for the purpose of providing the CalmCents service to you.

8. Account Termination

By you. You may delete your CalmCents account at any time from the account settings screen within the app. Deleting your account cancels any active subscription and initiates deletion of your account data from our systems within 30 days. Please cancel any active subscription through the Freemius customer portal before deleting your account to avoid future charges.

By us. We reserve the right to suspend or terminate your account, with or without notice, if we determine in our sole discretion that you have:

  • Violated any provision of these Terms
  • Engaged in fraudulent, abusive, or illegal activity
  • Created multiple accounts to circumvent trial or subscription restrictions
  • Taken any action that harms other users, the service, or Anchored Development Co.

In cases of material violation, we may terminate your account immediately. In other cases, we will provide notice and a reasonable opportunity to remedy the issue before termination. If your account is terminated for cause, you are not entitled to a refund of any prepaid subscription fees.

9. Disclaimer of Warranties

CalmCents is provided "as is" and "as available" without warranty of any kind, express or implied. To the fullest extent permitted by applicable law, Anchored Development Co. disclaims all warranties, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the service will be uninterrupted, error-free, or completely secure
  • Warranties regarding the accuracy, reliability, or completeness of any content or calculations within the app

CalmCents is a budgeting tool intended to help you organize your personal finances. It is not a financial planning service, and nothing within the app constitutes financial, investment, tax, or legal advice. You are solely responsible for all financial decisions you make.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Anchored Development Co. and its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use CalmCents, including but not limited to:

  • Loss of data or inability to access encrypted budget data
  • Loss of profits, revenue, or anticipated savings
  • Service interruptions or downtime
  • Unauthorized access to your account by third parties

In all cases, our total aggregate liability to you for any claim arising from or related to these Terms or your use of CalmCents shall not exceed the total subscription fees you paid to us in the three (3) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Nova Scotia, Canada, without regard to its conflict of law principles. The federal laws of Canada also apply where relevant.

Any dispute arising from or relating to these Terms or your use of CalmCents shall be subject to the exclusive jurisdiction of the courts located in Halifax, Nova Scotia, Canada. If you are located outside Canada, you agree to submit to the personal jurisdiction of those courts.

12. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by one or more of the following means:

  • A notice displayed within the CalmCents app
  • An email to the address associated with your account
  • An update to the "Effective Date" at the top of this page

Changes take effect 14 days after notice is provided, except in cases where changes are required by law, which may take effect immediately. Your continued use of CalmCents after that period constitutes your acceptance of the updated Terms.

If you do not agree to the updated Terms, you may cancel your subscription and delete your account before the changes take effect.
